User Agreement for Vacaz

Welcome to Vacaz! This User Agreement ("Agreement") governs your use of the Vacaz application ("App") provided by Vacaz Team ("we," "us," "our"). By accessing or using the App, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, please do not use the App.

1. Use of the App

• Eligibility: By using the App, you affirm that you are at least 17 years of age or have obtained consent from a parent or legal guardian if required by the laws of your jurisdiction.

• License: We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to the terms of this Agreement.

• Account: In order to use certain features of the App, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.

2. User Responsibilities

• Content: You are solely responsible for the content you upload, share, or interact with in the App, including paintings, comments, and other submissions ("User Content"). You represent and warrant that you have all necessary rights to the User Content and that it does not infringe on any third-party rights.

• Prohibited Activities: You agree not to engage in any of the following activities while using the App:

￮ Posting or sharing harmful, offensive, or inappropriate content.

￮ Attempting to hack, interfere with, or disrupt the normal operation of the App.

￮ Using the App to solicit or transmit any unsolicited or unauthorized advertising, promotional materials, or spam.

3. Intellectual Property

• Our Content: All content within the App, including the design, text, graphics, logos, and software, is owned by Vacaz Team or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without prior written permission from us.

• User Content: You retain ownership of the User Content you submit, but by submitting it, you grant us a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute the User Content in connection with the operation of the App.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

5. Termination and Suspension

• Termination by You: You may terminate your use of the App at any time by deleting your account and uninstalling the App.

• Termination by Us: We may suspend or terminate your access to the App at our sole discretion if we believe you have violated this Agreement or engaged in any conduct that could harm the App or other users.

6. Disclaimers and Limitation of Liability

• No Warranty: The App is provided "as is" and "as available," without any warranties of any kind, either express or implied. We do not warrant that the App will be error-free or uninterrupted.

• Limitation of Liability: To the fullest extent permitted by law, Vacaz Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Vacaz Team, its officers, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the App, violation of this Agreement, or infringement of any third-party rights.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of local. Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of local.

9. Changes to This Agreement

We may update this Agreement from time to time. Any changes will be effective when posted in the App or on our website. You are encouraged to review this Agreement periodically for any updates or modifications.
